Digital records show no effect on diabetes care

NEW YORK (Reuters Health) - Electronic health records have been held up as a way to improve medical care, but a new study suggests they are not necessarily making a difference in diabetes treatment.

The study, of 42 physician practices in two U.S. states, found offices that used electronic records actually gave lower-quality diabetes care than those that stuck with old-fashioned paper records.

On the bright side, diabetes management actually improved across all the practices over the course of the study period. But offices using electronic records lagged.

The findings highlight the fact that switching from paper to e-records, alone, is not enough, according to lead researcher Jesse C. Crosson, an assistant professor at the UMDNJ-Robert Wood Johnson Medical School in Somerset, New Jersey.

"Just having these records doesn't mean they're being used in a meaningful way," Crosson said in an interview.

More needs to be done, he said, to help medical practices translate electronic records into better care.

The study, which appears in the Annals of Family Medicine, adds to others showing that digital records do not magically improve medical care on their own.

Electronic records have been part of a push to improve healthcare quality and cut costs. That's because digital records can, among other things, allow doctors, hospitals and other providers to communicate more easily -- with the goal of preventing errors and making sure patients get the tests and treatments they need.

Some electronic systems also have "decision support" software that gives doctors tips on how to best treat individual patients.

The U.S. Congress authorized up to $27 billion in government incentives to get doctors and hospitals to switch to "meaningful use" of health information technology. And by 2015, providers will face penalties if they don't switch.

"Meaningful use" means steps like having up-to-date medication lists for each patient, electronically prescribing drugs, and giving patients electronic copies of their health records if they request.

But so far, studies on the impact of electronic records have been mixed.

There's some evidence that going digital may help cut down on unnecessary tests -- but that benefit may be limited to larger doctor-hospital networks using the most-advanced electronic systems.

And it's not clear how much of an effect e-records have had on overall quality of care.

For the new study, Crosson's team focused on diabetes care at 42 medical practices in Pennsylvania and New Jersey, 16 of which had switched to electronic records.

They measured patients' quality of care by looking at how many were getting recommended tests, including regular blood sugar, blood pressure and cholesterol checks -- and, if necessary, medication to rein in high numbers.

Over a total of three years, the study found, quality of care generally improved.

At the outset, 44 percent of all patients were meeting treatment guidelines, for example. That had improved to 52 percent at the two-year mark.

But offices using paper records actually did a little better. In those practices, 61 percent of diabetes patients were getting recommended tests two years into the study. That figure was 51 percent among practices using electronic records.

It's not clear why the gap existed, according to Crosson.

He said they had no information on the specific features of the electronic systems offices were using. So it's not possible to say whether certain systems or software features are more effective than others.

But Crosson also pointed to the human element: doctors and their staffs need to shift their mindsets, as well as their records systems. "There needs to be a change in the way doctors think about the delivery of care," Crosson said.

That might include having someone on staff who calls patients with chronic conditions, like diabetes, to "check in to see how they are doing," he said.

The study does have limitations, Crosson's team points out. One is that the data were collected between 2004 and 2006 -- and the systems used right now in many doctors' offices may be different.

Electronic records are not the only quality-improvement measure that researchers and policymakers are considering. Information from patients' e-records can also be used in so-called "pay-for-performance" plans.

Those plans offer financial incentives to doctors who achieve certain goals that are known to improve patients' health, reduce errors or save money.

Some governments, in Canada and the UK, for example, have tested pay-for-performance plans -- as have some doctor-hospital networks in the U.S.

But a study published last month found that an Ontario program seemed to have made no impact on diabetes patients' quality of care.

Another new study, also in the Annals of Family Medicine, points to similar results in the UK. Looking at 29 family practices in London, researchers found that pay-for-performance incentives have had little impact on long-standing racial disparities in diabetes care.

According to the researchers, that all suggests broad policy shifts are, by themselves, insufficient. More "targeted" steps also seem necessary, they say.

For now, Crosson said, people with diabetes -- or other chronic conditions -- should not assume they are getting top-notch care simply because their doctor's office has gone digital.

"Even if they are using electronic records, things may still be falling through the cracks," Crosson said.

He suggested that people find out what types of tests and treatments are guideline-recommended for their particular health problem. If you have diabetes, one source would be the American Diabetes Association, he said.

Another good source, Crosson noted, is the U.S. Preventive Services Task Force -- an expert panel that makes testing recommendations on a variety of health conditions.

Now that Mitt Romney has officially secured enough delegates with his Texas primary victory to clinch the Republican nomination, Mormons seem like a block of voters the Republicans can count on come November. This isn?t just because Mr. Romney is Mormon.

It?s because the Republican Party is now securing support from voters of every major religion in the United States, with the exception of Islam.

For nearly three decades Christian Evangelicals have tended to be reliably Republican. (Today, 70 percent of white evangelical Protestants support the GOP.) But now Mormons, Jews, and Catholics are getting on board with the party in increasing numbers. If the GOP is able to consolidate the support of the major religions in the US, Romney and other Republican candidates stand to win big at the polling booth in 2012 and well beyond.

Certainly, voters of a certain religion don?t always vote as a bloc, and recent trends indicate that some young Evangelicals are rejecting the ?partisan pulpit? and embracing traditionally liberal or Democratic values. But these religious groupings have had historic party allegiances that played out on election day as confirmed by the Pew Research Center Survey in 2009 following the 2008 presidential election.

Seeing a Mormon frontrunner in Romney may have helped earn Mormon support for the GOP, but the social conservative dimensions of the Republican platform also fit nicely within the Mormon faith. A strong commitment to traditional family values is the bedrock of both Mormonism and Republicanism.

At the graduation ceremony at Liberty University, founded by Jerry Falwell, Romney spoke of a worldview shared by his religion and Evangelicals; one committed to traditional family values ? a direct refutation of President Obama?s stance on same-sex marriage. A recent Pew survey found that Mormon support for the Republican party has grown from 68 percent in 2008 to 80 percent in early 2012.

Traditionally Democrats have been able to count on the support of Jewish voters. But when Barack Obama came out in support of a proposal that would return Israel to its 1967 borders, there was clear backlash among the Jewish and pro-Israeli communities. Republicans were able to align themselves with Jews and Israeli leaders in denouncing the proposal as a threat to Israel?s security.

Catcher bolsters Clemens' claim on B12 needles

(AP) ? Roger Clemens' former catcher with the Toronto Blue Jays testified Wednesday that he had seen vitamin B12 "shots lined up ready to go" for players, a claim also made by Clemens and for which he was charged with obstructing Congress.

Clemens is charged with obstruction of Congress, perjury and making false statements for denying to Congress in 2008 that he ever used steroids or human growth hormone. The obstruction count contains 13 allegedly false statements, including Clemens' assertion in his congressional deposition that "four or five needles" of vitamin B12 would be "already lined up ready to go" in the trainers' room after games. The government maintains that Clemens concocted the B12 account as a cover for steroid injections.

During the trial, prosecutors have asked several government witnesses associated with major league teams whether they've ever seen B12 shots lined up, and all of them have said no. But on Thursday, the first full day of defense witnesses, former catcher Charlie O'Brien replied "yes sir" when defense lawyer Rusty Hardin posed that question.

O'Brien, who played with Clemens in 1997, also testified that the secret to the pitcher's longevity was a split-fingered fastball. That was testimony designed to counter the government

Boston's assistant general manager at the time, Steven August, testified he recommended that the team re-sign Clemens.

"I told Mr. Duquette that Roger was at the top of his game," August said. But in fact, Clemens had gone only 40-39 in his last four seasons with Boston, and had mediocre earned run averages over 4.00 in two of those years. His career turned around when he joined the Blue Jays. August, who said he was good friends with Clemens, called the pitcher "extremely hard working," and said that younger players couldn't keep up with him during runs. He said that Clemens was in the top echelon of pitchers.

On cross examination, prosecutor Gil Guerrero told August, "You understand he's not on trial for how great" a baseball player he was, perhaps out of exasperation of all of the testimonials that Clemens was receiving.

The defense began its case Tuesday with one of Clemens' former high school teammates in Texas. Todd Howey said he and his friends would see Clemens jogging on Friday nights while they were out "looking for trouble." Clemens did so many runs in the outfield that he dug a trail that looked like it had been carved by a cow in a pasture, the witness testified.

"I've yet to see anybody work like Roger Clemens," Howey said. Despite the dedication, Clemens was not an exceptional pitcher back then, he said, reaching only 83-84 mph on his fastball. But when Howey played against him in college ? Howey for Texas Tech and Clemens for the University of Texas ? Clemens was throwing a lot harder.

"He proved us all wrong," Howey said, who talked so fast he had to be slowed down by the court reporter and Clemens lawyer Hardin. "You

Mike Capel, a former major league pitcher and longtime friend of Clemens, had played against him in high school and was a teammate in college. He made a similar observation about Clemens' transformation in college into a harder throwing, more athletic and trimmed down pitcher compared with high school. He said Clemens had a "very, very, very good" work ethic.

Capel said Clemens made a point of taking care of his body. During cross-examination Wednesday, Guerrero asked Capel if in coming to that conclusion, he took into consideration some substances that Clemens has admitted taking. The pitcher has said that he took the stimulant ephedra, before it was banned by Major League Baseball, and that he used to eat "Vioxx like it was Skittles." Vioxx, an arthritis medication, was withdrawn from the market in 2004 because a clinical trial revealed increased risk of heart attack and stroke.

Capel said he didn't know what Vioxx was, and that he did not take Clemens' use of ephedra into account in his previous comment. Prosecutors tried to exclude the glowing testimony on grounds that seven government witnesses already testified during cross-examination how hard Clemens worked. They wrote in a filing late Monday that it invited jurors to infer that because Clemens didn't use performance-enhancing drugs early on, he must not have later in his career.

Prosecutors argued that if the testimony were to be allowed, the judge should let them rebut it with evidence from other players who also worked hard but still used steroids or HGH.

But U.S. District Judge Reggie Walton ruled against them on both counts.

"Athletes who are hard workers tend to last longer and perform better," said Walton, a former athlete himself who went to college on a football scholarship.

'Angry Birds' debit cards to be issued in Russia

Russian fans of the game "Angry Birds"?will soon be able to get special debit cards ? or "Angry Cards" ? giving them discounts on the game's products.?

Moscow-based Promsvyazbank said Tuesday it will start issuing the new MasterCards on June 4. They will be printed with images of the various characters and will give users a 10 percent discount on all Angry Birds-branded products.

Besides debit cards, the bank will also issue Angry Bird cash cards, which users top up with money. The bank will pay a 4 percent annual interest rate on the card's balance.

The maker of "Angry Birds," Rovio Entertainment, has already launched toys and baby clothes lines featuring "Angry Birds" characters. But the Russian debit card is going to be the first "Angry Birds"-branded financial product. The game has been downloaded more than 10 million times in Russia.

Ivan Pyatkov, director for retail sales and technology at Promsvyazbank, told the Associated Press that the bank is planning an initial printing of 50,000 cards but hopes to issue twice as much by the end of the year.

The bank expects the card to help attract urbanites between 25 and 35 years of age with a monthly income of at least $1,000.

Pyatkov said the bank is receiving a large number of requests for Angry Birds cards following early reports in the Russian press.

"Some clients are demanding their Angry Birds cards right now ? before the official launch," Pyatkov said.

Promsvyazbank will be launching the card in partnership with Internet Retail Solutions, Rovio's agent in Russia.

Promsvyazbank, ranked as Russia's 11th largest by the Interfax research center, is 74 percent-owned by two Russian tycoons, the Ananyev brothers. Commerzbank holds 14 percent in the lender via a subsidiary while the European Bank for Reconstruction and Development has a 12 percent stake.?

Find content that is related, but can be conveyed in short vignettes.

After exhaustive study, and this is no small thing, being new to Texas and having to bone up on everything as a noob, and knowing full well I am a noob so may be making some glaring errors ? point it out please before Tuesday if I am ? I have come to conclusions about Republican candidates in upcoming primaries.

It?s important to do this because voting is next Tuesday and I figure it doesn?t do a whole hell of a lot of good to send someone to Washington as president if you don?t also send other people to DC that will back him up. And that means state support too. Because one of the big conflicts between federal and state government is the clash of federal power with state power. Don?t believe me? Look at all those medical marijuana facilities getting raided by the feds. Cancer patients can do medical marijuana in California, according to California state law. But the feds keep breaking down doors anyway. Not to mention since I?m shoving for a return of state power, well, maybe I better get cracking on what?s happening in the state. Sheesh. So many politics. So little time.

THE MAX ADAMS REPUBLICAN TEXAS PRIMARIES CHEAT SHEET

President: Ron Paul.

United States Senator: Glenn Addison: Addison?s the one guy staunchly in favor of constitutional rights. Like, not getting beat to shit when you peacefully protest and not getting thrown in jail for the rest of your life without charges or a lawyer or a trial. He?s anti-war. And he?s the one guy vocally supporting Ron Paul.

District 10 Rep: Eddie Traylor. Technically Traylor is not good. But his opposition is Michael McCaul. McCaul=CISPA. Throw that bastard out and vote Traylor.

District 17 Rep: George Hindman. I don?t really like Hindman either, he appears to be pro war. But he?s good on the Constitution and protecting citizen?s rights and his opposition is Bill Flores. Flores supports NDAA. Throw that bastard out and vote Hindman in.

District 21 Rep: Richard Morgan. Richard Morgan is all good. Yay! Also one of his opposers is Lamar Smith. Lamar Smith=CISPA. Vote that bastard out and vote Richard Morgan in.

District 25 Rep: Uncommitted. I can?t find anyone with any redeaming qualities running in this one. Several of them are flat out bad, and a couple of them I just can?t find info on online. Sorry District 25. You guys are screwed unless you come up with a write in candidate.

District 35 Rep: Rob Roark. Rob Roark is all good. Yay!

Railroad Commissioner: Becky Berger. Becky Berger has the smartest, most well written explanation and justification for why she should be the Railroad Commissioner. She?s also the best educated and qualified by her background. And she?s not a career politician, a lawyer, or one of Rick Perry?s appointees. [As far as I am concerned, if you are one of Rick Perry's people? That is a black mark.]

Railroad Commissioner Unexpired Term: Barry Smitherton. This is really a default choice because Elizabeth Murray-Kolb appears pro-fracking [wtf!] and the other two guys look bad. So Smitherton is one of those ?do the least damage? choices.

Place 2 Justice Supreme Court: Steve Smith
. Steve Smith gets a star from me and his opposition Don Willett is a Bush/Perry crony. Vote that bastard out and vote Steve Smith in.

Place 4 Justice Supreme Court: Uncommitted. David Medina is a Perry person. John Devine looks bad. And I can?t find anything about Joe Pool Jr. online to give me much of an idea about him.

Place 6 Justice Supreme Court: Nathan Hecht. He?s running unopposed and looks okay.

Presiding Judge Court of Criminal Appeals: Uncommitted. Sharon Keller is running unopposed. There?s a lot of nasty baggage here, going back to an appeal she refused to look at, saying, ?We close at 5.? Granted, the guy being appealed for by his attorneys appears to have been a real monster who had already lost two appeals, but this sort of response is not necessarily what you want sitting on the bench if your loved one, or you, are on death row.

Place 7 Judge Court of Criminal Appeals: Barbara Parker Hervey. Running unopposed. Looks okay.

Place 8 Court of Criminal Appeals: Elsa Alcala. Running unopposed. Looks okay. You should check out this woman?s back story too. It?s pretty amazing.

District 5 Member State Board of Education: Steve Salyer. Steve Salyer gets a star from me.

District 10 Member State Board of Education: Rebecca Osborne. She?s a teacher, she?s very well educated with a PhD, she?s strongly involved and very pro the students. She gets a star from me.

District 14 State Senator: Uncommitted. Guy Fielder is running unopposed and I just can?t find enough information on him online to form an opinion there. Sorry Fielder, might want to work on that internet presence.

District 21 State Senator: Grant Rostig. Grant?s a Ron Paul supporter. Yay!

District 24 State Senator: Uncommitted. Troy Fraser is a natural resources guy and I couldn?t find info much outside of that on the guy.

District 25 State Senator: Anyone but Jeff Wentworth. Seriously. The guy was a spook, a lawyer, and now looks like a careerist politician. That?s not a good combo. His opposition is Donna Campbell, who looked bad, and Elizabeth Ames Jones who pretty much wins by default not because she?s great, but because she?s the least bad. But looks pretty establishment generic. Oh well.

District 47 State Representative: Paul Workman. He is anti NDAA, which is good, though he looks a little gun rabid. Oh well. This IS Texas. Everyone is gun rabid. His opposition is Ryan Downtown who is seriously establishment. Establishment status quo is bad. Vote that bastard out and vote Paul Workman in.

District 48 State Representative: Robert Thomas
. Robert Thomas is firmly anti-NDAA. Though tragically I have lost the link that demonstrates that. Oops. Also running unopposed.

Place 2 Justice 3rd Court of Appeals: Jeff Rose. Running unopposed. Looks okay.

Place 3 Justice 3rd Court of Appeals: Madeleine Connor
. She looks solid and her opposition Scott Field doesn?t.

Place 5 Justice 3rd Court of Appeals: Uncommitted. David Puryear is running unopposed there. Just couldn?t find enough on him to make a solid estimation.

Place 6 Justice 3rd Court of Appeals: Bob Pemberton
. Bob Pemberton looks all good. Yay!

Sheriff: Raymond Frank. Frank is a Ron Paul guy. Yay! He also says he is against the misuse of tasers. Double yay!

County Tax Assessor-Collector: Vik Vad. He?s running unopposed. He seems okay.

Precinct 3 County Commissioner: Ira Yates. It took a lot of digging to find info on Ira Yates and I was kind of despairing and then I found info and bam, he got a star for massive expertise and hands on personal and professional experience.

Precinct 2 Constable: Toby Miller. He wins because he looks okay and his opposition Harrera appears pro war on drugs. Ugh.

Precinct 3 Constable: J Miller. He wins because I can?t find much on his opposition and he?s got a long track record in law enforcement that looks decent and he?s also done lots with K9 units. [I trust dog people over most other people. Right or wrong, it's a character fluke. Sorry.]

There are four issues on the ballot. I?m for school choice, for repealing the mandatory purchase of health insurance that?s unconstitutional, for prohibiting government restriction of public prayer, not because I?m big on public prayer but because I think it?s a freedom of speech issue and I?m pro freedom of speech. I?m still studying this balanced budget thing and don?t know much about what that?s about. And I don?t know much about this redistricting issue. Though historically, redistricting is usually an establishment tool used to disenfranchise opposition so I?m not big on it generally. But I have to study more.

Discovery promises unique medicine for treatment of chronic and diabetic wounds

ScienceDaily (May 28, 2012) ? A unique new medicine that can start and accelerate healing of diabetic and other chronic wounds is being developed at Ume? University in Sweden. After several years of successful experimental research, it is now ready for clinical testing.

Behind this new medicine is a group of researchers at the Department of Medical Chemistry and Biophysics who have made the unique finding that the protein plasminogen is a key-regulator that initiates and accelerates wound healing by triggering the inflammatory reaction. Their discovery is now being published in the journal Blood.

?Today we have the knowledge needed to develop a medicine,? says Professor Tor Ny, one of the authors of the article. ?The bulk of the preclinical research has been completed, and we have had meetings with the Medical Product Agency to discuss a program for clinical testing.?

Plasminogen is a well-known plasma protein that is produced in the liver and found in all bodily fluids. The Ume? researchers have now re-assessed its role and managed to show that the concentration of plasminogen increases dramatically in and around wounds, which is an important signal to start the inflammatory reaction required for healing. In diabetic wounds the level of plasminogen does not increase in the same way, and this seems to be the reason why these wounds do not heal. In diabetic mice and rats the researchers were able to show that the healing process starts immediately when plasminogen is injected around the wound, which then heals fully.

A cell line for producing plasminogen on a larger scale has also been developed, and the goal is to start clinical testing as soon as funding can be arranged. The researchers have high hopes, as plasminogen is an endogenous protein that can be assumed not to produce side effects.

The need for a biologics for treating chronic wounds is urgent. Diabetic wounds that do not heal are the most severe type of chronic wounds, affecting millions of people annually. Many of the roughly 350 million diabetes patients in the world develop foot ulcers, and in 10-15 million cases this ultimately leads to amputation. Today?s treatment of diabetic wounds consists primarily of traditional wound care, with compresses and bandages; there is no effective medication.

The Ume? researchers are initially concentrating on diabetic wounds, but plasminogen also has great potential for working on other types of wounds. This includes tympanic membrane perforations and periodontitis. Being a pro-inflammatory activator, plasminogen has moreover been shown to be effective in combating antibiotic-resistant bacteria (MRSA).

Tropical Storm Bud Pelts Mexico?s Pacific Coast

PUERTO VALLARTA, Mexico -- Driving rain pelted Mexico's Pacific coast early Saturday as a weakened Tropical Storm Bud moved by a string of laid-back beach resorts and small mountain villages south of Puerto Vallarta.

Yahoo! Music, Sony, Universal and Metallica News, May 26, 2012

News this past week stressed the seismic music industry shifts of the past decade as experts analyzed why the Yahoo! Music service is booming and explored Sony?s increase in market share and its implications on the hotly-contested EMI deal. Also, Metallica members talked about their struggles to stay afloat in the current business climate.

Yahoo! Music Thriving Under the Radar

?

Yahoo! Music is enjoying 27 million monthly U.S. visitors despite massive industry changes; yet, this success seems to be escaping the attention of artists and music executives, according to a recent article on Billboard.biz. While the company got some negative media coverage recently when it lost some major executives, Ken Fuchs, the president overseeing sports, entertainment, music and other verticals claimed the recent changes will not affect Yahoo! Music.

?

And to which factors does he attribute the success of the service? Fuchs stated that it is a combination of brand alignment, the availability of robust emerging artist services, mobile services and the company?s focus on breaking original ground:? ?[The recent staff change] certainly doesn?t affect our mission and our ability to continue to build on creating a great voice on breaking news and original programs.? He added that Yahoo! is ?ramping up in video programming,? which includes interviews, video series and live and on-demand concerts.

?

In April, the site enjoyed 171 million unique visitors in the United States, declared a report from comScore. And Fuchs said that its popularity has been building excitement among music fans both on and offline, which has helped the service direct traffic around its diverse offerings, or, as Fuchs stated, ?the water-cooler events that create conversation and create context for that conversation. It could be a big concert. It could be breaking news.?

Major artists account for a lot of the traffic. Whitney Houston?s funeral was among the top 10 live streaming events in Yahoo?s history. And the Clinton Foundation Concert, which saw performances by Lady Gaga, Bono and Usher had more than one million live streams at the time of broadcast and has garnered well over 20 million video streams and 13 million content interactions since it aired. The popularity of these events has brought brands like Nissan and Unilever into the fold to sponsor genre-specific major events with big artists.

However, Fuchs stressed the growing popularity of Yahoo! Music can also be good for emerging and independent artists, because the focus of the service is always on ?music discovery:?? ?We try to do it in a fairly intimate way, through strong editorial, access to artists and, more and more, original programming and live performances that create a very unique canvas to perform and interact with their fan bases.?

?

Yahoo! has also introduced several products across its different platforms that could significantly add to the strength of its music service. One is the Yahoo! ?Social Bar,? a social media interaction tool that has been downloaded by over 68 million and sees about 40 million monthly users. The ?IntoNow? mobile app could also help Yahoo! better serve music fans and artists by informing Yahoo! of music listeners? preferences. It tracks the shows people watch and delivers this information to Yahoo! so they can shape their programming. Fuchs said it works similarly to Shazam and SoundHound:? ?You can be watching a football game or CNN or a live concert and it will understand and pick up the signal regardless of what?s coming out of you TV and drop into an experience where you can get more information, you can interact with friends around that show ? It allows the user to get deeper, especially around big events like concerts or sporting events or the Grammys.?

Above all, Fuchs continues to hope that Yahoo! Music will continue to grow by giving consumers what they want musically:? ?We believe in being able to extend our experiences across screens and scale. So whether it?s a concert with the National and Bob Wier that?s fully available across all screens, or it?s the Clinton concert or breaing news, we don?t really care where you?re accessing it from, we want you to be able to access it.?

Sony vs. Universal:? Who Will Win the War for Top Tracks?

?

Although the spotlight is currently on the EMI deal, with many industry analysts and critics scrutinizing the fairness of Sony Entertainment?s and Universal Music Group (UMG)?s takeovers of two divisions, no one seemed to notice Billboard.biz?s report that Sony overtook Universal in U.S. market-share rankings over a month ago until this past week. And the experts at Billboard stated this is because those in the music industry fretting over the potential deal might be picking the wrong battle.

?

Sony surpassed UMG in year-to-date album market share including track equivalents in the first week in March. It also held the #1 spot during the month, only relinquishing control in the final week of the first quarter, ending April 1. Recent figures from Nielsen SoundScan reported that UMG?s market share for music albums is 30.35 percent, vs. Sony?s 29.14 percent, which contradicted numbers from SounScan, which reported the two companies were even closer, at 29.98 and 29.36 percent, respectively.

Despite the on-going battle for market share between the two major labels, critics continue to focus on the EMI merger, which still has an uncertain outcome, as no final decisions have yet been made by trade commissions. They have failed to notice the race between Sony and UMG for top spots on the charts, which many feel could provide important insights into the future of the label system.

?

Billboard stated that whether Sony or UMG will ultimately grab more market share likely depends on album release schedules. Many analysts are banking on Adam Lambert?s ?Tresspassing? to put Sony over the top, even though that album has not had as many weekly scans as other #1s before it. Sony has some big releases coming up, including albums from One Direction, Usher, Kenny Chesney and R. Kelly. And these releases, on paper, look stronger than the releases on the UMG side, who will only have Justin Bieber?s ?Believe? and Maroon 5?s ?Overexposed,? both going on sale in June.

?

However, analysts at Billboard noted that which company wins the market share for albums has become less of a focus than which has put out the most popular individual tracks. And a look at the popularity of albums has seen Sony on top almost every single week this year so far. But UMG has been the winner when it comes to individual tracks through this past week:? 32.66 percent vs. Sony?s 25.89 percent. If Sony wants to win the war, it will have to keep a steady schedule of strong individual track releases.

Metallica:? Touring to Stay Afloat

?

The dissolution of the former business models within the music industry as it makes way for new income streams has seen even big bands like Metallica working harder for a buck, according to an article in Rolling Stone, reported by Classic Rock magazine.

?

Metallica guitarist Kirk Hammett stated that, while the band used to be able to take a few years off after a big album release and accompanying tour, thanks to dwindling music sales and royalties, members now have to be on tour almost constantly to stay afloat:? ?The cycles of taking two years off don?t exist anymore. We were able to do that because we had record royalties coming In consistently. Now you put out an album and you have a windfall maybe once or twice. But it?s not the way it used to be ? a cheque every three months.?

Quiet Revolution's old dreams fuel Quebec protests

MONTREAL (AP) ? Quebec's generous social services date back to sweeping reforms in the 1960s, a period of intense nationalism. Yet many Quebecers look back at the "Quiet Revolution" with regret over one unfulfilled promise: free higher education.

That sentiment is fueling Canada's most sustained student demonstrations ever. It has been anything but quiet.

Some 150,000 students in more than a dozen Quebec colleges and universities have been on strike since February to protest the provincial government's plan to raise tuition fees. Street protests in Montreal have ended in clashes with police and mass arrests.

A strict new law designed to stop the demonstrations has only broadened the movement to include separatists and Occupy protesters, and triggered a wider debate over public freedoms. The students are threatening to persevere through the summer, just when the city traditionally awakens from its dark and frigid winter for jazz and comedy festivals that draw in millions of dollars in tourist revenue.

The French-speaking province's average undergraduate tuition ? $2,519 a year ? is the lowest in Canada, and the proposed hike? $254 per year over seven years ? is tiny by U.S. standards. But opponents consider the raise an affront to the philosophy of the 1960s reforms that set Quebec apart not only from its U.S. neighbor but from the rest of Canada.

"The whole consensus around education was built around the Quiet Revolution," said Pierre Martin, a political science professor at the Universite de Montreal. "That consensus would tend toward a tuition-free model in the future. That was a promise."

As a result, he said, Quebecers don't compare their tuition rates to those in the U.S. or English-speaking Canada, but to those in European countries where higher education is free.

Quebec Premier Jean Charest, who has vowed to shake up the debt-ridden province's finances since he was elected nearly a decade ago, has refused to cave.

More than 2,500 students have been arrested since the demonstrations began more than 100 days ago, including nearly 700 this past Wednesday alone. The total is five times the arrests during a period in the 1970s when soldiers were deployed to the streets in Quebec because of a spate of terrorism by a group demanding independence from Canada.

The tuition hike is part of a broader effort to shift Quebec's fiscal burden away from taxpayers ? the province has some of the steepest personal income taxes in North America and the highest per-capita debt in Canada? and onto the shoulders of each person who uses a service.

"Every citizen has to do their part," Quebec Finance Minister Raymond Bachand told The Associated Press in a telephone interview. "This is the 21st century."

Bachand said the students want more money in their pocket to the detriment of others. He noted that the government has expanded student grants so that middle and lower income students can more easily afford the increase.

"We're talking about 50 cents a day so basically it's moved from a question of tuition fees to a question of a social movement like you've seen in other parts of the world," Bachand said. "We're not used to this as Canadians. We're used to sitting down, disagreeing, negotiating and coming to an agreement."

In an effort to restore peace, Charest's government passed emergency legislation on May 18 restricting protests and closing striking campuses until August. The law requires that police be informed eight hours before a protest begins, including details on the route of any demonstration of 50 or more people. It also prohibits demonstrations within 50 meters (165 feet) of a college and declares that anyone who incites or helps another person break the new protest regulations can be fined.?

The new law has "changed the discourse now and introduced a new element into the debate, and that is the question of rights," said Bruce Hicks, a political scientist at Concordia University. The students have challenged the law in court.

Provincial Public Safety Minister Robert Dutil said Quebec cities are simply joining others that already have tough rules for organizing protests, including Los Angeles and New York.

"Law 78" has inspired a particularly cacophonous form of protest: from 8 p.m. to 8:15 p.m., people around Quebec emerge onto sidewalks and balconies to bang pots and pans.

Anne Claude, a 23-year-old computer student banging pots with a friend one evening in the heart of Montreal's Latin Quarter, said the law has only increased her resolve to be heard.

"The new law limits our ability to demonstrate," Claude shouted over the noise.

Across the street, pizza parlor owner Naeem Ahmed shook his head when he recalled the sight of an open fire hydrant gushing water into his business and a bonfire lit dangerously close by.

Ahmed, 37, has had a front row seat to more than 30 straight nights of protests. Confrontations between helmeted police and students have scared customers away. Students sometimes seek shelter in his establishment to escape police sweeps.

"For businesses it has been really, really horrible," Ahmed said, taking a break with some of his employees to look at cellphone footage of a recent protest. One of his employees joined the pot-bangers, clanging two trash lids together.

"Police come and ask everybody to leave," he said.

Still, he sympathizes with the students. "If you go to any country, when the students hit the streets, you have to listen to them," he said. "When they come out you have to accept it."

The student groups and the government have announced their intention to return to negotiations in the next days, with Quebec Education Minister Michelle Courchesne saying she expects a "very, very important" session following positive discussions over the phone.

But the two sides seem far apart. Student leader Gabriel Nadeau-Dubois wants to propose a long-term plan that would essentially fulfill the promise of the Quiet Revolution: scrapping university tuition fees altogether within five years and funding that by increasing taxes on financial institutions.

That is the opposite of what the government wants.

"Sacred cows only exist in India," the finance minister has repeatedly said.
